- A settlement has been reached in class action lawsuits against Big Fish Games, Inc., Churchill Downs Incorporated, Aristocrat Technologies, Inc., and Aristocrat Leisure Ltd. (“Defendants”), alleging claims based on the sale of virtual chips in the following social casino-style games: Big Fish Casino, Jackpot Magic Slots, and Epic Diamond Slots. Defendants deny all claims and that they violated any law, but have agreed to the settlement to avoid the uncertainties and expenses associated with continuing the case.
- You are a Settlement Class Member if you played Big Fish Casino, Jackpot Magic Slots, and/or Epic Diamond Slots in the United States on or before Preliminary Approval of the Settlement.
- Those who file timely and properly completed claims will be eligible to receive a share of the Settlement Fund. Your share will depend on, among other things, (1) the total dollar amount of in-game purchases you made while playing Big Fish Casino, Jackpot Magic Slots, and Epic Diamond Slots, with those who spent more money receiving a higher percentage back, (2) whether or not your claims are potentially subject to the Dispute Resolution Provision in Big Fish Games’ Terms of Use, and (3) how many Settlement Class Members submit claims.
- Please read the Notice carefully. Your legal rights are affected regardless of whether you act or do not act.

In support of Breast Cancer Awareness Month this October, Big Fish is donating $225,000 to National Breast Cancer Foundation, Inc.® (NBCF), to be paid on or before December 31, 2019. Big Fish also pledged an additional $25,000 toward in-kind activities for employees including assembling NBCF HOPE kits for 300 breast cancer patients across the country.
Big Fish is also running two free themed in-game events so players can join together and raise awareness too! Participation is voluntary, gameplay is free, and there is no purchase necessary to participate or win. The donation by Big Fish to NBCF is not determined or influenced by gameplay time or in-game purchases.
The two events are as follows:
(1) Between 09/26/19 12 AM PDT and 10/4/19 11:59 PM PDT, players can “play for a cause” to show support for breast cancer awareness through special free in-game events featuring NBCF-branded pink gameplay. Participating Big Fish free-to-play games include:
- Cooking Craze
- Decurse
- Fairway Solitaire
- Gummy Drop!
- Big Fish Casino
- Jackpot Magic Slots
The more time players are “playing for a cause,” the more rewards they will unlock in game. No purchase necessary to participate or win.
Details vary according to the participating game title. For Jackpot Magic Slots:
- Players work together to spin and fill a pink ribbon meter. Players see pop-ups & notifications over the course of the event showing global progress and can win a pink ribbon avatar frame!
Big Fish Games Community Game-Off
(2) Between 10/01/19 12 AM PDT and 10/31/19 11:59 PM PDT, players can “play for a cause” to show support for breast cancer awareness through a free community game-off between seven Big Fish free-to-play games. Participating Big Fish free-to-play games include Big Fish Casino, Cascade, Cooking Craze, Decurse, Fairway Solitaire, Gummy Drop and Jackpot Magic Slots. The game with the most minutes played* wins the free community game-off. All players that played the winning game during the game-off time earn a special in-game reward beginning 11/01/19 12 AM PDT. Reward details vary according to the participating game title. No purchase necessary to participate or win.
*The game with the largest percentage increase in cumulative total minutes played from the prior 30-day period.

Why did Big Fish choose to support the cause for Breast Cancer?
We chose Breast Cancer Awareness for the Big Fish for a Cause campaign because breast cancer continues to be one of the leading health crises for women in the United States and the majority of our players are women, many of whom have shared their stories and inspired us.
